CAG's Preliminary Report and Supreme Court Ruling

Establishment:

Independent authority under Article 148 of the Indian Constitution.

Primary Role:

Audits all expenditures and receipts of central and state governments, as well as government-funded organizations.

Constitutional Provisions:

  • Articles 148-151, 279: Cover CAG’s appointment, duties, and reporting.

Appointment & Tenure:

  • Appointed by: The President.
  • Tenure: 6 years or until 65 years of age, whichever is earlier.

Functions:

  • Audits: Consolidated Fund, Contingency Fund, and Public Accounts.
  • Audits: Government-funded departments, companies, and bodies.

Reporting:

Submits audit reports to the President (for Parliament) and to the Governor (for State Legislatures).

Responsibility:

Ensures government spending aligns with parliamentary approval.

Limitations:

Limited audit role in some public corporations and government companies.
